Introduction: Previous findings that inattention and hyperactive/impulsive symptoms predict later peer problems have been mixed. Utilizing two culturally diverse samples with shared methodologies, we assessed the predictive power of dimensionally measured childhood IA and HI symptoms regarding adolescent peer relationships.Methods: A US-based, clinical sample of 228 girls with and without childhood diagnosed attention-deficit/hyperactivity disorder was assessed and followed 5 years later. A Norwegian, population-based sample of 3,467 children was assessed and followed approximately 4 years later. Both investigations used parent and (...) teacher reports of ADHD symptoms and peer relations. Multivariate regression analyses examined the independent contributions of IA and HI symptoms to later peer problems, adjusting for baseline childhood peer problems. We also examined childhood sex as a potential moderator within the Norwegian sample.Results: Higher levels of childhood HI symptoms, but not IA symptoms, independently predicted adolescent peer problems in the all-female clinical sample. Conversely, higher levels of IA symptoms, but not HI symptoms, independently predicted preadolescent peer problems in the mixed-sex population sample. Results did not differ between informants. Associations between ADHD symptom dimensions and peer problems within the Norwegian sample were not moderated by child sex.Discussion: Differential associations between childhood hyperactive/impulsive and inattention symptoms and adolescent peer problems were found across two diverse samples using a shared methodology. Potential explanations for different findings in the clinical vs. population samples include symptom severity as well as age, sex, and cultural factors. We discuss implications for future research, including the importance of dimensional measures of ADHD-related symptoms and the need for shared methodologies across clinical and normative samples. Introduction: Emotional fluctuations and mood swings are common among adults with Attention Deficit/Hyperactivity Disorder. Here we investigated if these problems could be retrospectively traced back to childhood behavior.Methods: Adults with an ADHD diagnosis and a population-based control sample completed the Adult ADHD Self-report Scale, the Wender Utah Rating Scale and the Mood Disorder Questionnaire. All participants also provided self-reported information about co-existent psychiatric and somatic diseases, and demographic data. Reports on the MDQ were used to define subgroups with [MDQ] and (...) without [MDQ] life-time periods of emotional fluctuations and the WURS scale was used to retrospectively assess childhood ADHD related behaviors and symptoms.Results: 50.2% of the ADHD group and 5% of the controls were defined with emotional fluctuations [MDQ]. Childhood behavior ratings of “impulsivity,” “loosing of control,” and “trouble with authorities” independently predicted emotional fluctuations reported in adulthood via logistic regression analyses. Inclusion of these three items in a classification analysis gave an accuracy score around 70% in identifying each of the two MDQ categories in the ADHD group.Discussion: The strong association between self-reported features of emotional problems in childhood and in adulthood suggests a trajectory that should be detected and remediated at an early age. Future longitudinal studies should prioritize the examination of developmental mechanisms explaining the persistence of emotional problems from childhood into adulthood. (shrink)

Although accountability lies at the heart of the “doing gender” perspective, it has received surprisingly little attention from gender scholars. In this article, I analyze the different ways that scholars have conceptualized accountability. I propose a synthesis of these various understandings, and demonstrate the utility of this conceptualization with examples from my research on feminist self-defense training. This analysis sheds light on both the workings of accountability and the process of change in gender expectations and practices. Traditional approaches to measurement of violations of academic integrity may overestimate the magnitude and severity of cheating and confound panic with planned cheating. Differences in the severity and level of premeditation of academic integrity violations have largely been unexamined. Results of a study based on a combined sample of business students showed that students are more likely to commit minor cheating offenses and engage in panic-based cheating as compared to serious and planned cheating offenses. Results also indicated there is a (...) significant interaction between severity and type of cheating. We hypothesized serious and planned cheating offenses would be related to justifications and found the largest differences were between panic and planned. Finally, panic and minor cheating were associated with two self-control-related personality traits. Implications for cheating research are discussed. (shrink)

Interpretations of Euripides’Heraclesoften focus on Theseus’ and Heracles’ cooperative social values in the final scene as a culmination of themes ofphilia. I argue that the relationship Theseus forges competes with Heracles’ attachment to his household,oikos, which is the central social relationship Euripides describes. The drama consistently develops Heracles as his household's leader by inviting the audience to compare Heracles with interim caretakers Megara and Amphitryon, and later through the protagonist's performance of emotional attachment before and after his madness. The closing (...) scene continues to reveal the value and vulnerability of household attachment by accentuating Heracles’ exclusion from the identity of human family member. This trajectory suggests a painful misalignment between Heracles’ experience in theoikosand the public position Theseus offers at Athens: of a semi-divine hero receiving public cult and honours. Euripides emphasizes this tension to distinguish the experience ofoikos-membership. (shrink)

Machine learning-based AI algorithms lack transparency. In this article, I offer an interpretation of AI’s explainability problem and highlight its ethical saliency. I try to make the case for the legal enforcement of a strong explainability requirement: human organizations which decide to automate decision-making should be legally obliged to demonstrate the capacity to explain and justify the algorithmic decisions that have an impact on the wellbeing, rights, and opportunities of those affected by the decisions. This legal duty can be derived (...) from the demands of Rawlsian public reason. In the second part of the paper, I try to show that the argument from the limitations of human cognition fails to get AI off the hook of public reason. Against a growing trend in AI ethics, my main argument is that the analogy between human minds and artificial neural networks fails because it suffers from an atomistic bias which makes it blind to the social and institutional dimension of human reasoning processes. I suggest that developing interpretive AI algorithms is not the only possible answer to the explainability problem; social and institutional answers are also available and in many cases more trustworthy than techno-scientific ones. In this paper, I offer a personal and professional narrative of how Canada went from prohibition to permission for medical assistance in dying. I describe the legal developments to date and flag what might be coming in the near future. I also offer some personal observations and reflections on the role and impact of bioethics and bioethicists, on what it was like to be a participant in Canada's law reform process, and on lessons that readers in other jurisdictions might take (...) from Canada's experience. I investigate the normative and conceptual account of the relationship between public recognition and dignitarian, or egalitarian, commitments. I do so through addressing the normative dispute, sparked by legal cases such as Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Commission and Fulton v. City of Philadelphia, as to whether there are dignitarian grounds for rejecting religious exemptions to antidiscrimination laws. I argue that there are such grounds. Specifically, I argue that, if granted, such exemptions would inflict dignitary harms against LGBTQ (...) individuals by denying them the public recognition necessary for reliably sustaining civic self-respect. Such exemptions would deny this recognition in two distinct ways. First, such exemptions would institutionalize humiliation of LGBTQ individuals as market actors. Second, such exemptions would condition market access for LGBTQ individuals on unequal terms. Through making this argument, I hope to make three primary, and related, contributions: I introduce a concept of civic self-respect; I argue that the normative import of public recognition is grounded in the good of civic self-respect; and I rely on this normative framework to show how religious exemptions to public accommodations laws inflict dignitary harms. My argument is relevant to both political philosophers and legal scholars grappling with questions of why public recognition matters and what it demands. (shrink)

J’esquisserai pourquoi je considère que ce constructivisme est préférable à la fois au réalisme moral et au constructivisme kantien sur le plan de la compréhension du statut ontologique des valeurs. Après avoir accepté de reconnaître le rôle des pressions de l’évolution dans l’émergence de la moralité, le constructivisme humien doit toutefois préciser le rôle de l’intersubjectivité historique dans l’évolution subséquente de la (...) morale. J’expliquerai aussi pourquoi je considère que l’intégration d’un volet cohérentiste au constructivisme permet d’atténuer les craintes concernant le caractère potentiellement non-cognitiviste des théories contextualistes. Enfin, j’esquisserai pourquoi l’idée d’un «espace des raisons morales» indépendant, à certains égards, de l’esprit humain est compatible avec le constructivisme humien.I defend a version of what Sharon Street has dubbed “Humean constructivism.” I’ll first sketch out why I think that contextual constructivism provides us with a more plausible understanding of the ontological status of values than both Kantian constructivism and moral realism. In addition to its recognition of the role of evolutionary pressures in the emergence of human morality, contextual constructivism must now clarify the role of historical intersubjectivity in the subsequent development of morality. I will then claim that adding a coherentist module to Humean constructivism provides a satisfactory answer to those who fear that contextual metaethical theories can only be non-cognitivist. Finally, I will sketch out why I think that the notion of a mind-independent “space of moral reasons” is largely compatible with Humean constructivism. (shrink)

Medical assistance in dying (MAiD) has received considerable attention from many in the field of bioethics. Philosophers, theologians, lawyers, and clinicians of all sorts have engaged with many challenging aspects of this issue. Public debate, public policy, and the law have been enhanced by the varied disciplinary analyses. With the legalization of MAiD in Canada, some attention is now being turned to issues that have historically been overshadowed by the debate about whether to permit MAiD. One such issue is voluntary (...) stopping eating and drinking (VSED) as an alternative to MAiD. In this paper, I will apply a legal lens to the issue. An understanding of whether VSED is legal provides a foundation for ethical reflection on whether it ought to be permitted. Is it permitted for those who prefer VSED to MAiD? Is it permitted for those who do not qualify for MAiD under our current legislation – for those who do not have a grievous and irremediable medical condition, for mature minors, for individuals whose sole underlying medical condition is a mental disorder and who do not otherwise meet the eligibility criteria, and for individuals who have lost capacity but had completed an advance directive? This article explores how Anglo-American financial firms since the 1980s have operated and acted in an increasingly deregulated, risky, and uncertain arena. I look at these firms and their actions with a particular focus on “temporality” and requisite “emotion-rules,” where variations in emotion-rules correspond with organizational definitions of uncertainty. Firms impose specific emotion-rules, depending on national policies, official duties, and interpretations of each risk. In finance, caveat emptor (i.e., buyer or lender distrust) is an emotion-rule set in screening policies and (...) data collection for credit risks and risks of fraud by personnel, and it gives rise to actual emotions. I argue that three time-orientations are significant in creating emotion-rules. If a past, present, or a long-term future is deployed to construct a future, that creates and frames an institution’s attempts to manage uncertainty. Looking exclusively at Anglo-American corporate finance policies and strategies (often deemed the international “one best way”), six modes of certainty constructions are presented. Each is assessed against the dispositions and emotional strategies required in highly-skilled careers, in specific organizational settings. The relative influence of individual perspectives, institutional rules and general typologies of social action is assessed and found to comprise one past view, three present views, and one future-oriented perspective towards the future. Implications are outlined for emotion-rules relevant to financial careers and office. (shrink)

A number of phenomena have lent a new complexity to the long-standing challenge of constructing a legitimate and stable political order. I contend that both legitimacy and integration under contemporary conditions ultimately hinge upon a form of public practical reasoning that departs considerably from the ones proposed by John Rawls, Jürgen Habermas and several deliberative democrats. I argue that the generalizability test that constitutes the cornerstone of most contemporary neo-Kantian theories of public reason should be abandoned as a rule of (...) public argumentation and be replaced by a norm of civic responsiveness towards minority claims. I not only suggest that a wider variety of reasons, motives and genres of speech needs to be admitted within the purview of public reason, but more fundamentally that generalizability cannot cogently be seen as anything more (or less) than a civic virtue. The underlying point of this article is that neo-Kantian theories of public reason work with a problematic conception of practical reason. I conclude by providing reasons, against some radical and agonistic democrats, why the language of public reasoning needs to be retained and renovated. I nonetheless suggest that liberal culturalism as a normative theory, even in Patten’s sophisticated version, is ill suited to deal with the challenges related to the status of religion in the public sphere that are so prevalent in contemporary democracies. In addition, I submit that Patten did not supply a fully convincing answer to the argument that liberal egalitarianism, well understood, (...) is capacious enough to secure fair terms of social cooperation for members of cultural minorities, making the language of “cultural rights” and “cultural recognition” superfluous. | : Le livre Equal Recognition d’Alan Patten contribue de façon majeure aux travaux de philosophie politique sur les droits des minorités culturelles. Using mostly prospective menstrual data from mothers and daughters in the Tremin Trust Menstrual Reproductive History Program, this study produces the first estimates of the genetic correlation between the ages of menarche and menopause. I carried out two separate analyses. Standard regression analysis of 21 mother/daughter dyads with natural menopause yielded a nonsignificant negative mean genetic correlation of r A =−0.139±1.268. Survival analysis/maximum likelihood estimation on a dataset which included an additional 85 dyads with censored observations on daughters yielded a (...) nonsignificant positive genetic correlation of r A =0.613±0.587. Although a substantial non-zero correlation cannot be ruled out, these estimates suggest there is no genetic correlation between menarche and menopause, in agreement with previous phenotypic findings. As inconclusive as they may be, these estimates also contribute to our understanding of the nature of selection working on the reproductive life span of human females. (shrink)

L'hypothèse qui guide le présent article est que les méthodes et techniques de dérivation ou de modélisation utilisées en éthique contemporaine, ont une incidence sur les contenus proprement moraux de la théorie morale ; vues comme de simples outils à l'usage du philosophe moral, elles agissent en fait comme des sources de normativité morale. Cette hypothèse n'est pas une simple reformulation de l'idée voulant qu'il existe, au sein de la théorie morale, un rapport entre explication et justification ou entre méta-éthique (...) et éthique. Pour le montrer, je m'appuierai d'abord sur une caractéristisation générale de ces composantes de la théorie morale et des rapports qu'elles entretiennent entre elles. Dans un deuxième temps j'arguerai que l'usage d'outils méthodologiques particuliers peut avoir une incidence sur les contenus moraux proprement dits. Pour caractériser cette incidence et en décrire les mécanismes, je ferai d'abord appel à une approche pragmatique de l'explication, puis je donnerai deux exemples, tirés de la philosophie morale contemporaine, et illustrant le fait que certains contenus moraux ainsi introduits échappent de fait à une justification en bonne et due forme.The central claim made in this article is that the various methodological devices used by contemporary moral philosophers in order to represent or derive moral principles affect the very moral content of their theory; seen by them as mere tools for philosophers, they in fact are sources of moral normativity. This claim is not a mere reformulation of the idea that there is within moral theory a connection between explanation and justification or between metaethics and ethics. To show that this is so, I first give a general characterization of the various components of moral theory and of their relationships. I then argue that the use of particular methodological devices affect the very moral content of the theory. To characterize such incidence and its mechanisms, I first appeal to a pragmatic conception of explanation and, finally, I discuss two examples from contemporary moral theory showing that substantive moral claims so introduced, in fact fail to be justified. La question de l'allégeance morale au libéralisme politique occupe une place centrale dans la théorie de John Rawls. J'arguerai d'abord que, dans la conception de Rawls, le moral et le politique entretiennent un rapport paradoxal qui risque de compromettre l'institutionnalisation de la raison publique telle que Rawls la conçoit. Je proposerai ensuite une nouvelle définition des conditions de l'allégeance morale au libéralisme politique. J'arguerai que ma définition, tout en évitant la tension relevée chez Rawls entre le politique et le moral, (...) est aussi mieux adaptée aux représentations contemporaines du citoyen en tant qu'agent moral et plus conforme aux intuitions courantes concernant le rôle de la moralité dans une démocratie constitutionnelle.The problem of the moral allegiance to political liberalism is central in the theory of John Rawls. It will be argued first, that, as Rawls conceive them, the moral and the political practically stand in a paradoxical relationship which undermines the possibilities for the implementation of "public reason". A new characterization of the conditions of moral allegiance will be articulated. I will then argue that my characterization removes the tensions between the moral and the political I noticed in Rawls. It also yields a better understanding of the actual representation of the citizen as a moral agent and finally, gives a more accurate account of the role of morality in contemporary constitutional democracies. J’arguerai ici que tout en repoussant d’une main une conception du changement social basé sur la sélection naturelle des pratiques sociales et des individus qui y participent, les théories normatives qui font appel à des modélisations des choix sociaux, qu’ils soient de nature économique, politique ou morale, en entretiennent potentiellement les conséquences. Plus précisément, j’arguerai que les modèles que l’on utilise encore le plus volontiers dans les sciences sociales, c’est-à-dire ceux de la théorie des jeux, de la théorie de la (...) décision ou de la négociation rationnelle, contribuent à répercuter, au plan normatif, les deux aspects — social et individuel — de la sélection naturelle. L’argument s’appuie sur une analyse de la théorie standard de l’utilité et montre que la conception de la rationalité maximisante définie dans ce cadre formel incorpore les exigences de la sélection à celles de la rationalité.I shall argue that though most theoreticians of social change firmly refuse normatively to endorse the natural selection of practices and individuals, they sometimes tacitly validate the consequences of such a conception of social change. More precisely, I shall argue that the formal apparatus still often used in social sciences — such as game theory, bargaining theory or decision theory — contribute to carrying on, at the normative level the social and individual aspects of natural selection. The argument rests on an analysis of what has come to be regarded the standard theory of utility and attempts to show that maximising rationality defined in that framework incorporates the requirement of the selection to those of rationality. In this article, we compare Ricard Zappata-Barrero’s interculturalism with Tariq Modood’s multiculturalism. We will discuss the relation between distinct elements that compose both positions. We examine how recent discussions on interculturalism have the potential to contribute to theories of multiculturalism without undermining their core principles. Our position is close to that of Modood’s as he has already carefully tried to incorporate interculturalist insights into his own multiculturalism. Yet we provide a raise a few questions regarding Modood’s treatment of the relation (...) between multiculturalism and interculturalism. After summarizing each author’s potion (I), we will comment on the following set of relations between their basic elements: (II) The relation between intercultural contact and intercultural dialogue; (III) The relation between contact at the local level and the societal/state level; (IV) The relation between group-specific measures, intercultural contact and mainstreaming. This feminist analysis focuses on sexual harassment within a specific category of jobs known as display work, where primarily women’s bodies are commodified and sold to consumers, and often through the conduits of powerful male industry leaders. Using qualitative content analysis methods to analyze 88 subjective, first-person narratives of harassment from 70 models working within the fashion business, I describe how the commodification of bodies interacts with the particular features of the modeling industry—the premium placed on youth, ambiguous industry demands, (...) and the presence of kingmakers—to produce an environment in which opportunities for sexual harassment can proliferate. All these factors impose extreme worker vulnerability costs on predominantly women and ultimately contribute to maintaining gender-based, hierarchical power differentials between men wielding authority within the industry and these models over time. Although he does not engage in a significant way (...) with political and legal philosophy and comparative law, his contextualist and pragmatic approach is a powerful antidote against oversimplification and dogmatism with regard to exemption claims. Unsurprisingly, Greenawalt’s approach comes at times dangerously close to casuistry, and some of his analyses and normative recommendations would benefit from a firmer footing in moral principles and rational argumentation. In this review, I flesh out some of the strengths and limits of Greenawalt’s valuable book. (shrink)

It seems reasonable to say that the basic problem of Husserl’s phenomenology is the possibility for the mind to get related to the world. In Brentano’s view, intentionality was a universal characterization of the mental. In Husserl’s, it becomes as well the framework of the possible contact of the mind with the world. As Hilary Putnam observes: “‘Brentano’s thesis’ was meant by him to serve as a way of showing the autonomy of mentalistic psychology (‘act-psychology’) by showing that the mental (...) was separate from the real (external) world. Brentano himself, to my knowledge, never used the word ‘intentionality’, nor did he use the terms ‘intentional inexistence’ and ‘intentional existence’ to refer to the relation between mind and the real world, as philosophers have come to use the word ‘intentionality’ after Husserl.”1 * I owe my understanding of what Wittgenstein says on ‘intentionality’ to Bouveresse 1987, p.279-302. My further criticism of ‘intentional objects’, and my present conception of intentionality, was also deeply influenced by Vincent Descombes’s realist strand of intentionalism. See Descombes 1995 and 1996. John McDowell (see “Intentionality and interiority in Wittgenstein”, reprinted in McDowell 1998a, 297-321, among other papers) gave me the decisive clue as to the problem of the basic ‘harmony’ between thought and reality in Wittgenstein, and illuminating discussions with Jean-Philippe Narboux, in particular on the occasion of a lecture in which he presented a sharp criticism of Husserl’s conception of indexicality, helped me to measure up all the difficulty of a comparison with Husserl. As to my awareness of the trouble one may have ‘meaning’ and sticking to a use, I owe it to Stanley Cavell’s radical reading of Wittgenstein that shows that realism makes room for scepticism, far from extinguishing it, and Sandra Laugier’s sensitive research in the field of moral philosophy, following in the footsteps of Cora Diamond, drew my attention to the role some experiences play in overcoming such difficulty (as the lack of such experiences can make it a dead-end).. In this paper I explore the power of money in bioethics research and ask whether, while casting stones regarding financial conflicts of interest in health research, bioethics researchers are in fact living in glass houses. I first review the need for money in bioethics research, the sources of money, and key features of the money. Next I explore a range of possible objectives for the money transfer. I then examine the effects of this transfer and raise some questions and concerns (...) about the role of money in bioethics research. I close with some suggestions for possible responses to these questions and concerns—suggestions concerning what bioethics researchers as individuals and as a community could do to more positively and progressively harness the power of money in bioethics research. Medical assistance in dying has received considerable attention from many in the field of bioethics. Philosophers, theologians, lawyers, and clinicians of all sorts have engaged with many challenging aspects of this issue. Public debate, public policy, and the law have been enhanced by the varied disciplinary analyses. With the legalization of MAiD in Canada, some attention is now being turned to issues that have historically been overshadowed by the debate about whether to permit MAiD. One such issue is voluntary stopping (...) eating and drinking as an alternative to MAiD. In this paper, I will apply a legal lens to the issue. An understanding of whether VSED is legal provides a foundation for ethical reflection on whether it ought to be permitted. Is it permitted for those who prefer VSED to MAiD? Is it permitted for those who do not qualify for MAiD under our current legislation – for those who do not have a grievous and irremediable medical condition, for mature minors, for individuals whose sole underlying medical condition is a mental disorder and who do not otherwise meet the eligibility criteria, and for individuals who have lost capacity but had completed an advance directive? This paper aims to expose and analyze the Aristotelian interpretation of Parmenides’ philosophy. In the first place, the refutation of Parmenides’ monism in Phys. I 2-3 is analyzed. Then a series of relevant passages from the corpus are commented in which Aristotle refers both to the ontology and cosmology of Parmenides and to his methodology of philosophical investigation. It is proposed a compatibilist interpretation of the Aristotelian reading of Parmenides, according to which the latter would have affirmed the unity and (...) immobility of reality according to concept and its changing plurality according to sensory perception. While the Platonic influence on certain aspects of the Aristotelian interpretation is evident, this is not a mere reception and repetition of Plato‘s reading. Indeed, Aristotle seems to have understood Parmenides’s thought from a methodological distinction operating in Phys. I 5. (shrink)

In recent philosophy it has been much disputed whether the content of perception is conceptual or not. This paper advocates the view that it is trivial to say that the content of perception is conceptual, if one considers perception in its mere epistemic significance. In this regard, the concept of perception is indeed completely determined by the idea of the object of perception. The concept of perception, however, is bi-dimensional. Perception, certainly, is essentially intentional. However, a certain reality plays an (...) essential part in it: the one of the sensible being that can be determined thus or thus in a perception, but that, as sensible reality, nevertheless remains as it is. Gestalt Theory can be interpreted as an exploration of one side of this reality, insofar as it has to do with something other than the intentionality of perception: i.e. with those structures of the perceivable thing that make it perceivable. In perception, the reality of the sensible element and the unreality of content should be logically distinguished. Thus, to open a new, non-epistemic dimension for perceptual realism, is possible. Nakon što je pokazao da je nemoguće reducirati intencionalnost na puke izvanjske odnose, on naglašuje da nije moguće niti pojmiti ju ekskluzivno kao unutarnji odnos. Nema intencionalnog unutarnjeg odnosa bez njegova konteksta izvanjskih odnosa koji mu dopuštaju da djeluje. Autor pokušava pokazati primjer za to analizirajući problem determiniranja intencionalnosti kao povezane s anticipativnom strukturom intencionalnosti, s posebnom pozornošću, s jedne strane, prema stvari ambigviteta, te s druge strane, (...) prema onoj nemogućnosti. On pokušava pokazati da sposobnost intencionalnosti da sebe determinira ovisi o uvjetima koji pripadaju okolnostima. Njegova demonstracija je na liniji s nekom vrstom eksternalizma u filozofiji uma.The author asks whether intentionality could be described as an internal or an external relation. Afterhe has shown that it is impossible to reduce intentionality to mere external relations,he emphasizes that it is not possible either to consider it to be an internal relation exclusively.There is no intentional internal relation without its context of external relations that permit it towork. The author tries to make a case for that by analyzing the problem of the determination of intentionalityas related to the anticipative structure of intentionality, with special attention on theone hand to the issue of ambiguities and on the other hand to the one of impossibilities. He tries toshow that the ability for the intentionality to self-determine depends on conditions which pertain tocircumstances. His demonstration is in line with some kind of externalism in the philosophy of mind. (shrink)

Cette approche vise à introduire le lecteur au problème de la saisie conceptuelle de la notion d'égalité et de la détermination de son contenu. C'est l'occasion de discuter si cette notion peut répondre à une fonction heuristique ou bien si elle n'a qu'un rôle éristique. L'hypothèse développée est qu'une telle notion constitue plutôt une représentation schématique de celle de justice. (...) La vacuité principielle du schème d'égalité a, par ailleurs, toujours pour effet de nous reconduire en définitive à l'examen de sa fonctionnalité opérationnelle.I set up at first the notion of equality within the historical context of modern industrial society, so that its genesis is recalled to mind. This way of approach aims at placing the reader in front of the problem which consists in apprehending conceptually the notion of equality and in determining its content. That gives the opportunity to inquire thereinto, if the considered notion may have an heuristic value or else only an eristic character. The unfolded hypothesis is that such a notion provides rather a schematic depiction for the one of justice. From the scholarly activity of the fourth and fifth centuries A.D. stem several collections of scholia to the poems of Virgil, most of which make copious reference to prose and verse composed in Latin before Virgil's time. The authors of these scholia were the last of a long line of commentators whose labours began soon after Virgil's death. Just as Virgil walked in the tracks of Theocritus, Hesiod, Aratus, Nicander, Homer, and Apollonius, so did his students in the tracks of (...) the great Alexandrian expositors of the Greek poets. They sought to explain Virgil not only through Virgil himself, but also through the poets and prose writers, Greek and Latin, whom they imagined Virgil to have read. Thus we have scholia citing early republican literature in order to parallel words uncommon in or absent from the fourth-century classical syllabus, as well as unclassical usages, inflections, and constructions; in order to demonstrate ‘imitations’ on the part of Virgil; and in order to elucidate the structure of episodes of the three poems where Virgil appears to depart from the most commonly known versions of myth and history. Argument concerning the text or interpretation of a disputed passage is frequently based on appeal to the usage of Virgil's Latin predecessors. (shrink)

There had long been known Diogenes Laertius' account of the χ (...) and other signs placed in the margins of texts of Plato's dialogues, Hephaestion's account of the colometrical παράγραος, κορωνίς, διπλ and στερίσκος placed in texts of lyric and dramatic poetry, the chapter de notis sententiarum in Isidore's Origines, the names of various treatises περσημείων mentioned in the Suda, the references to σημεα in Eustathius' commentary on Homer' and in the marginal scholia to Homer, Hesiod, Pindar, Aeschylus, Sophocles, Euripides and Aristophanes in Byzantine manuscripts, Cicero's allusions to the βελός and the διπλ scattered reports of the signs with which Origen equipped Greek versions of the Old Testament and Jerome's adaptation of Origen's system, and Cassiodorus' account of his own method of noting orthodox and heterodox opinions in ecclesiastical writings. L'auteur analyse les deux figures du dépassement de la métaphysique qui ont existé au XXe siècle : la phénoménologie, après être partie d'une vigoureuse critique de la métaphysique, d'inspiration positiviste, a tendu à devenir une nouvelle sorte de métaphysique, puis, comme telle, a subi la critique de la philosophie analytique naissante. La question est posée de savoir ce qui pourrait être conservé aujourd'hui des deux traditions, phénoménologique et analytique, en termes de critique de la métaphysique. The author analyses both the (...) figures of the overcoming of metaphysics that existed in the XXth century : after starting from a strong criticism against metaphysics, of a positivist inspiration, phenomenology has tended to become a new kind of metaphysics, and then, as such, suffered the criticism of the newborn Analytic philosophy. Au livre V de l'Éthique à Nicomaque, Aristote ne donne pas une définition unifiée de la justice. Tout en ne rejetant pas la définition traditionnelle qui identifie la véritable justice et la justice légale, ni celle qui repose sur la justice naturelle et fonde la notion d'équité, il cherche de nouvelles assises pour la justice institutionnelle et c'est la notion d'égalité qui sert à cette fin. Cet article vise à préciser les notions de stricte égalité et d'égalité proportionnelle et corrélativement (...) à analyser les définitions des justices distributive et directive qui constituent les branches de la justice particulière chez Aristote.In the Fifth Book of the Nicomachean Ethics, Aristotle does not give one unified definition of justice. He does not reject the traditional definition of legal justice nor the definition of natural justice which is necessary to dread the idea of equity. However, he wants to ground institutional justice on a new base and the idea of equality serves this end. In this paper, I want to make clear the difference between strict and proportional equality and correlatively to analyse the definitions of distributive and "directive" justices which form the two branches of the aristotelian particular justice. Trois idées générales admises par Sr Prudence Allen font l'objet de notre (...) commentaire. Ce sont I'interpretation égalita-riste des idées de Platon quant aux différences sexuelles, la neutralité du concept d'homme et 1'interpretation philosophique de la complémenta-rite des sexes comme modèle des relations égalitaires. In this paper I distinguish moral “ought”-judgments, meaning “ought”- judgments that qualify as moral judgments, from “morally ought”-judgments, meaning “ought”-judgments whose “ought” is either prefaced (or followed) by the word “morally” or construable as so prefaced. Specifically, I argue that the former class of judgments is wider than the second. (As I show in section 3, this is not to argue for the already familiar distinction, or putative distinction, between a broad and a narrow sense of “moral.”) I also speculate (...) as to why the distinction exists, and, more important, show that it has important consequences. For instance, it undermines a tempting argument for moral subjectivism. (shrink)

In 1972 James Rachels published a challenging criticism of moral-point-of-view theories. It has never been answered. This is sur-prising, given that the species of theory to which it applies remains alive. In this paper I reply to Rachels’ criticism. My reply refers frequently to the work of G. J. Warnock and employs three distinctions that have been overlooked in the literature on moral-point-of-view theories. These dis-tinctions have relevance to more than Rachels’ paper.
